सिंटिला (en. Scintilla)

On a scrutiny of the entire factual scenario, there remains no scintilla of doubt that the order of termination passed against the petitioner is stigmatic and cannot be regarded as a termination simpliciter.

Therefore, this Court has absolutely no scintilla of hesitation nor even a shade of doubt to hold that the petitioner herein has not made out any case, warranting interference or indulgence of this Court under of the Constitution of India.

In the manner aforesaid regulations is worded, I have no scintilla of doubt that it is not merely procedural in nature, indeed it is mandatory in character.

In the light of of the Act of 1996 and the principles laid down by the Supreme Court, I have no scintilla of doubt that the and provisions contained therein will not apply to the present arbitral proceedings which were admittedly commenced before 23 rd October, 2015, the date when became part of the Statute Book.

Thus, there cannot be any scintilla of doubt that his seniority shall be computed from that date.

In view of the above reasons and having regard to valid and cogent reasons recorded by the appellate Court, this Court has absolutely no scintilla of hesitation nor any traces of doubt to hold that the substantial question of law which is a prerequisite for entertaining and admitting the second appeal under Section 100 of the Code of Civil Procedure is totally and conspicuously absent in the present case.

From the aforesaid enunciation of law there remains no scintilla of doubt that interlocutory orders on certain circumstances, could be appealed against under the Letters Patent.
