Learned Appellate Court upon appreciation of evidence on record as also the judgment passed by learned Trial Court returned the findings that in the facts of the case, it could not be said with a definite opinion that when plaintiff came to know that his as well as names of some other persons were excluded from the voter list and when he was not allowed to file his nomination papers, he did not manhandle the Election Officer or issued threats as alleged by the defendants.
